Accused Philadelphia cop killer Eric Lewis faces new federal gun, robbery charges after deadly ambush

The man accused of ambushing two Philadelphia police officers, killing one and wounding another, now faces federal charges.

Eric Lewis, 35, is accused of fatally shooting Philadelphia Police Officer Shane Seiber and wounding his partner. He faces a range of state charges, among them murder, homicide of a law enforcement officer, attempted murder, 10 counts of attempted homicide of a law enforcement officer, aggravated assault, terroristic threats and other related offenses.

In addition to the state-level charges, Lewis on Thursday was indicted on federal charges of interstate commerce by robbery, discharging a firearm during a crime of violence, possession of a firearm and ammunition by a felon, theft of a firearm that has moved in interstate commerce, and possession of a stolen firearm and stolen ammunition.

"Under federal law, Eric Lewis is not allowed to possess a firearm. He is a convicted felon under federal law. He is certainly not allowed to steal a firearm, and under federal law, he is certainly prohibited from using any firearm to rob, shoot, and kill a police officer, as a result of those actions," Metcalf said.

Lindsay Clancy holdout juror won't have to turn over phone or face inquiry, judge says

The lone holdout juror who was the only one in favor of convicting her of murder for the strangling deaths of her three young children will not have to have his phone examined or face an inquiry from her defense attorney, a Massachusetts judge ruled Wednesday.

Judge William Sullivan denied Clancy attorney Kevin Reddington's motion for an evidentiary hearing.

Sullivan wrote that the potential evidence to dismiss the juror, referred to as Juror Doe in court documents but understood to be Michael Desronvil, came to light only after the mistrial was declared — which makes it irrelevant under court precedent.

LINDSAY CLANCY HOLDOUT JUROR'S LAWYER TORCHES 'LOONEY TUNES MOTION' TO INVESTIGATE HIM

The defense did not raise the issue that Juror Doe lied on the jury questionnaire before the mistrial was declared, he wrote — it originated in media reports.

"Because post-trial information potentially affecting Juror Doe's impartiality cannot be used to attack the determination that a mistrial was manifestly necessary, Clancy is not entitled to an evidentiary hearing on that issue," Sullivan found, while also noting that Reddington didn't raise the possibility that Juror Doe used a cell phone improperly until after the mistrial was declared.

LINDSAY CLANCY HOLDOUT JUROR ASKS FOR ONE THING IN NEW VIDEO AFTER MISTRIAL DRAMA

Any further inquiry into the holdout juror is inappropriate because of "the mandate that the court must not delve into a juror's subjective reasoning, thought process, view of the case, or relationship to the other jurors, and must not inquire into the jury's deliberative content, collective thought process, or any disagreement among the jury," Sullivan wrote.

Read the judge's order:

Desronvil told Fox News' Kayleigh McEnany last week that he stands by his decision not to compromise with 11 others who wanted her to be found not criminally responsible due to postpartum psychosis.

Grandfather gunned down in road rage attack days after burying Air Force son; convicted murderer charged

A Connecticut man who was sentenced to 30 years in prison for a 1992 felony murder conviction has been arrested again in connection with a road rage shooting that left a grandfather dead in Bridgeport, according to city police.

Jorge "George" Ortiz, 57, was arrested after a brief foot chase Monday to end a week-long manhunt and charged with murder, criminal possession of a pistol and carrying a pistol without a permit, Bridgeport police said in a statement.

He is accused of gunning down 48-year-old Nelson Batista, a grandfather who recently laid his 25-year-old Air Force airman son to rest, in a 9 a.m. road rage incident on Oct. 12, according to a police affidavit.

Ortiz and Batista were strangers, according to Bridgeport Police Chief Roderick Porter.

"This was a random act," he told reporters at a news briefing announcing the arrest — just hours before Batista's funeral.

Surveillance video shows a man identified as Ortiz following a woman down Park Avenue as the victim turned his SUV down a side street, according to the affidavit. Ortiz allegedly slapped his hands on the side of the car, prompting the driver to stop and get out.

Ortiz allegedly punched the victim first, and they fell to the ground in a scuffle before surveillance video showed them struggling for control of a handgun, according to the affidavit. The city's ShotSpotter program captured at least two gunshots, with the medical examiner later determining one struck Batista in the chest.

Philly officer murdered in line of duty promoted to sergeant as police from around US attend his funeral

PHILADELPHIA — Thousands of police officers from around the U.S. traveled to the City of Brotherly Love Tuesday for the funeral of Shane Seiber, who was shot and killed in the line of duty on Oct. 10, when prosecutors say an armed suspect shot him and his partner.

Philadelphia Police Commissioner Kevin J. Bethel announced during the service at the Cathedral Basilica of Saints Peter and Paul that Seiber had been promoted posthumously to the rank of sergeant.

Seiber had served 10 years in the department after spending the prior decade in the Air Force, where he deployed for two tours in Iraq.

Officers from around Pennsylvania and other states packed the memorial service to pay their respects.

Kansas soccer field crash raises red flags for former investigator who questions key theories

"Law enforcement certainly needed to do a better job as to describing why these charges haven't been filed," says Jamie Copenhaver.

Copenhaver, a former sheriff's detective in Florida who worked with an FBI Joint Terrorism Task Force, is curious as to why law enforcement has been tight-lipped about the lack of charges in the horrific Kansas soccer field crash.

A mother walked away with no charges after investigators say she drove onto the active field at Stryker Sports Complex where children and families were present — killing two and injuring several others.

CHILD AMONG 2 KILLED AFTER VEHICLE DRIVES ONTO SOCCER FIELD AT KANSAS SPORTS COMPLEX

It happened on Saturday; Cole Adrian, 6, and Nicholas Schafer, 35, who were both from McPherson, were killed. The woman behind the wheel was released after being interviewed by investigators that day.

Wichita Police said she was released "pending the results of toxicology testing and a mechanical examination of the vehicle."

Police said in a statement Tuesday that they have interviewed nearly 50 witnesses, with more interviews ongoing.

"Investigators are also inspecting the truck, analyzing available vehicle data and continuing investigative work at Stryker Sports Complex," police said. "They are working closely with the Regional Forensic Science Center and awaiting official, peer-reviewed toxicology results."

The driver remained at the scene and has been cooperative, they said.

"Based on the information available Sunday morning, and after consultation with the Sedgwick County District Attorney’s Office, investigators did not have probable cause to arrest the driver. She was released, and the investigation remains ongoing. Her release does not represent a final determination about whether criminal charges are appropriate."

"We know that this case has captured the attention of people all over the country, and many of those people have strong opinions about the incident even though they do not have direct knowledge of what occurred," Chief Joe Sullivan said. "We recognize that the decision the law and constitution required us to make on Sunday morning may not be popular. We swear an oath to support the laws of the State of Kansas and the Constitution of the United States and no one in the Wichita Police Department takes that oath for granted."

The driver had a valid driver’s license and no outstanding arrest warrants, police said.

They dispelled rumors circulating online, noting that the driver is not in the country illegally, has no documented criminal history, and no association with the Wichita Police Department, the Sedgwick County Sheriff’s Office or any other law enforcement agency.

Andrew Ford, a spokesperson for the Wichita Police Department, told TMZ that the driver was interviewed for several hours after the crash. He said she answered questions about what happened, according to the outlet.

Ford told TMZ that police are investigating all possibilities about why this happened, including whether speeding, mechanical failure, or drugs or alcohol played a factor.

Wichita police could not immediately be reached for comment.

Did the driver suffer a medical emergency?

No information on the driver's medical condition at the time of the crash has been released.

Copenhaver said it may be necessary for law enforcement to release information on the woman's physical health condition at the time of the incident to "prevent conspiracy theories."

"People need to know a little bit more transparency as to why this may have occurred," he said.

Did her vehicle malfunction?

Police said that the black pickup truck involved in the incident was going to undergo mechanical testing. Copenhaver said the black box will be able to give a better idea of whether something went mechanically wrong before the deadly crash.

He said the data will reveal possible "contributing factors" like speed, whether she hit the brakes, timing of the braking and how far the vehicle may have skidded.

"It doesn't take that long, in my opinion, to download that data, have one of their experts go over it," he said.

Copenhaver went on to say, "If there's an issue with that truck, that computer is going to alert the examiner or the expert that's looking at this data."

"If it's alcohol-related, they're going to know instantaneously," he said.

He added, "Once that blood draw is taken, once it's ran through the machines [investigators] will be able to tell you if an individual is under the influence of alcohol."

He said testing for other substances like hard drugs or medications can take significantly longer. Those require "specialty testing," he said.

Testing for that is "longer than that normal blood draw," he said.

Florida puts 77-year-old man to death for deputy's murder as state closes in on execution record

A 77-year-old Florida man was executed on Tuesday for killing a sheriff's deputy more than 40 years ago, marking the Sunshine State's 18th execution of the year as Republican Gov. Ron DeSantis continues an accelerated pace of executions.

William Reaves was pronounced dead at 6:12 p.m. at Florida State Prison near Starke following a three-drug injection. He was convicted of first-degree murder in connection with the September 1986 shooting death of Indian River County sheriff's deputy Richard Raczkoski.

Reaves said he did not have any last words.

About 30 seconds after the injection began, Reaves took several big breaths and then stopped moving. A few minutes later, the team warden shook Reaves’ shoulders and shouted his name, but the man gave no response. A medic checked for a heartbeat or other signs of life, and Reaves was pronounced dead about a minute later.

FLORIDA EXECUTES INMATE WHO KILLED CELLMATE BECAUSE HE WANTED DEATH PENALTY

Raczkoski's brother, Marc, told reporters after witnessing the execution that his brother finally received justice, while Indian River County Sheriff Eric Flowers said that he viewed the execution as closure rather than justice.

"Would we all be so lucky to be 77 years old and to die so peacefully," Flowers said at a press conference. "That’s not justice in any way, in my opinion."

On Sept. 23, 1986, Raczkoski responded to a 911 call that Reaves had made from a payphone at a Vero Beach convenience store, according to court records.

After the deputy arrived at the scene and the two men began talking, a gun fell out of Reaves’ pants, officials said. The two men struggled over the weapon before Reaves eventually regained control of it.

Raczkoski was attempting to run away when Reaves shot him four times, according to investigators. He died from his wounds later that day.

Reaves was convicted and sentenced to death about a year after the shooting. The Florida Supreme Court later overturned the conviction due to a conflict of interest with the prosecutor and ordered a new trial. After the second trial, Reaves was again convicted and sentenced to death, and subsequent appeals were unsuccessful.

The U.S. Supreme Court denied Reaves’ request for a stay of execution and petition asking the court to review his case without comment on Tuesday.

TWO FLORIDA INMATES DIE IN RARE DOUBLE EXECUTION AFTER SCOTUS DENIES STAYS

The state Supreme Court also rejected Reaves’ appeals last week that sought to halt the execution.

His attorneys challenged Florida’s three-drug lethal injection protocol. Executions in the state are carried out through the injection of a sedative, a paralytic and a drug that stops the heart, according to the Department of Corrections. The court has previously upheld the protocol against similar challenges.

Florida's method is different from the single-drug injection used in states like Tennessee, where death row inmate Christa Pike survived two doses of pentobarbital and was rushed to the hospital last month. Pike has since been released from the hospital and returned to prison.

Reaves' attorneys also argued that jurors who recommended the death penalty were never made aware that the U.S. Department of Veterans Affairs had rated the Army veteran as 100% disabled because of post-traumatic stress disorder linked to his service in the Vietnam War.

More than 100 military veterans appealed to DeSantis in a letter on Monday to halt the execution, pointing to those factors.

Reaves was the eighth Florida prisoner over age 70 put to death this year.

Florida has accelerated its pace of executions amid a flurry of death warrants signed by DeSantis since 2025. The governor oversaw a state record 19 executions last year, more than any other Florida governor in a single year since the death penalty was reinstated in 1976, accounting for approximately 40% of the U.S. total of 47 executions for 2025.

CLICK HERE TO DOWNLOAD THE FOX NEWS APP

Florida would tie last year's record if Jesse Guardado, 64, is put to death as scheduled on Nov. 5 for robbing and killing a woman to buy drugs in 2004.

Florida has carried out more than half of the 32 total executions in the country so far this year, including Reaves.

In July, Florida executed two prisoners in one day, the first time a state has done so in nearly a decade.

DeSantis has said he wants justice for victims’ families who have often waited decades for death sentences to be carried out.

The Associated Press contributed to this report.

Elderly Miss man killed with own gun in random home invasion as sheriff questions possible religious motive

An elderly Mississippi man was fatally shot with his own gun while fighting an alleged burglar inside his home, and his wife managed to escape, authorities said.

Union County Sheriff Jimmy Edwards told Fox News Digital that Eric Basco broke into Bobby McGill’s home around 4 a.m. Thursday while McGill and his wife were asleep.

McGill, 81, struggled with Basco, who got hold of McGill’s gun and fatally shot him multiple times, Edwards said.

"It appears that there was a struggle that had ensued between the assailant and the homeowner. And he had a pistol that he kept in his chest there at the foot of his bed," Edwards said. "It looks like to us that what we're piecing together, is that he may have tried to get that pistol and the individual was fighting him, and they had a fight and the guy got the pistol and shot Mr. Bobby multiple times."

McGill's wife, Peggy, was able to escape the home safely and called 911 to report that someone "came into their house and attacked her husband," Edwards said.

"And in Mr. Bobby's yard was a cross and a sign that said, 'Jesus is Lord.' So did that help lure him to that house? I don't know. I'm not saying it did. I'm not saying it had anything at all to do with it. But it's a question that I have in my head if that played a part or not. I don't know, we'll probably never know."

"It was a very sad, tragic thing, just for no reason," Edwards added.

She had two of her children inside the pickup. One of her children was playing soccer on a different field at the complex.

Investigators interviewed the driver and more than 30 witnesses, including the two children who were in the pickup at the time of the crash. Police consulted with the Sedgwick County District Attorney's Office before releasing her.

Three men get 158 years each for murdering American and Australian surfers, dumping bodies in Mexican well

Three men in Mexico received 158-year prison sentences Friday for the murders of Australian surfers Callum and Jake Robinson and their American friend Carter Redd Rhoad.

A federal judge in the town of Ensenada, Baja California sentenced Jesús Gerardo García, Irineo Francisco and Ángel Jesús each to 158 years and nine months in prison for murder, robbery with violence and vehicle theft with violence.

An accomplice of García's — Ary Gisell Silva Raya — was also convicted of aggravated robbery with violence and vehicle theft with violence and sentenced to 20 years in November after agreeing to an abbreviated trial.

García, Francisco and Jesús were convicted last week of killing the Robinson brothers and Rhoad, which authorities said was carried out in order to steal the tires from the deceased men's truck.

"The attackers pull out a gun they were carrying and kill the person who initially resisted the robbery, then on the other two," Baja California prosecutor María Elena Andrade said, according to a report from The Associated Press.
